General Terms and Conditions of Participation
EasyELEarning Academy GmbH · Version: 2 November 2026
1. Provider and scope
Your contracting party is EasyELEarning Academy GmbH, Saarburger Ring 10–12, 68229 Mannheim, Germany, represented by managing director Oliver Kölsch, registered with Mannheim Local Court under HRB 760038. Contact: studies@easyelearning.academy, telephone +49 6203 9609240. These terms cover bookings of training courses, workshops, exam preparation and digital learning services by consumers and businesses. Individually agreed terms take precedence. Existing bookings remain subject to the terms agreed when their contracts were concluded.
2. Services and contract formation
The agreed course description and booking confirmation define the services, format, duration, dates, teaching language, examination and materials languages, and included examination services. An enquiry alone is not a binding booking. By submitting the final order carrying an obligation to pay in our online shop, you make a binding offer. We accept by an express booking confirmation or by providing the booked service; a purely automatic acknowledgement initially confirms receipt only. For individual quotations, the quotation and its acceptance determine contract formation. Dates, languages and any physical venue must be agreed before delivery.
3. Prices and advance payment
The total price displayed before the binding order applies, including applicable VAT and other mandatory price components. Consumers must be able to identify the total amount payable before submitting the order. Payment is in advance according to the booking confirmation or invoice. The full invoice amount is payable before services begin unless individually agreed otherwise. Additional services are charged only when agreed. Mandatory rules applicable to a particular course, including the payment rules of the German Distance Learning Protection Act (FernUSG), take precedence over the advance-payment provision. Advance payments prohibited by law are neither agreed nor required in that case.
4. Delivery and minimum attendance
The Academy offers courses regularly. An agreed course runs with four or more registered participants. With fewer participants, we agree delivery or an alternative date with you. If a course is cancelled, we provide an alternative date and inform you without undue delay. The replacement date is agreed with you; statutory rights concerning non-performance, delay or an unreasonable replacement date, including any rights to terminate and obtain a refund, remain unaffected. Compelling circumstances may require a change even where minimum attendance has been reached.
5. Rescheduling and cancellation
You may reschedule to another date. You may transfer to another subject or course provided PECB examination registration has not yet taken place. No rebooking fee applies where the rebooking takes place within the first twelve months after the examination booking. Send your request, booking reference and preferred course or date to studies@easyelearning.academy. Availability and any difference in the prices of the services are agreed before rebooking; waiver of a rebooking fee does not automatically make different courses the same price. Rebooking outside this period requires individual agreement. This policy does not exclude statutory withdrawal, termination, cancellation or refund rights. Any additional voluntary cancellation with a refund is agreed individually; these terms impose no flat-rate cancellation fees.
6. PECB courses, examinations and certification
A full course and standalone examination preparation are different services. For the “self-study plus four hours of exam preparation” option, the agreed access to materials and the examination is provided through PECB. The Academy’s own live support covers general organisational information about the examination process only and does not teach the technical course content. This option does not replace a full PECB course. This distinction does not apply to multi-day Foundation or Lead courses expressly booked as full subject-matter courses. The booked offer states whether official materials, examination registration and examination fees are included. Attendance, passing an examination and subsequent certification are separate steps. Relevant PECB requirements and rules are made available before booking; examination success or certification is not guaranteed. Access to PECB learning materials lasts for the period specified by the PECB portal terms applicable to the particular offer and disclosed before booking. These do not replace our own contractual obligations.
7. Academy courses and access to materials
Academy courses include personal lifetime access to the purchased digital course content in the programme version agreed at booking. This does not automatically include all future course revisions, unlimited live support, repeat examinations or certificates of unlimited validity. Mandatory statutory update and defect rights remain unaffected. The agreed examination programme separately determines the validity and renewal of an Academy certificate. New QMB bookings include a final examination lasting 135 minutes in total under ELA-PRG-QMB, revision 1.0 of 31 October 2026, unless a later revision is expressly agreed.
8. Participation and permitted use
Participants must meet the professional and technical requirements specified in the offer. Login details are personal and must not be shared. Learning materials may be used for personal participation and study; unauthorised publication, resale or distribution is prohibited. Uses permitted by law remain permitted. Recording classes or examinations requires the necessary consent of everyone concerned. Our privacy policy explains the processing of personal data.
9. Defects and liability
Statutory rules on defects and liability apply. These terms do not introduce any limitation of liability. Please report technical or organisational problems promptly so we can remedy them; statutory claims are not subject to an additional contractual exclusion deadline.
10. Governing law and jurisdiction
German law applies. Consumers retain mandatory protections of the law of their habitual residence where these cannot be removed by a choice of law. Mannheim is the agreed jurisdiction for merchants, legal entities under public law and special funds under public law to the extent legally permitted. Statutory jurisdiction applies to consumers and other customers not covered by that agreement. Statutory provisions replace any invalid term.
11. Consumer right of withdrawal
If you enter into a distance contract as a consumer for our services or digital learning offers, you may withdraw without giving a reason within 14 days after conclusion of the contract. Statutory rules on when the period begins and any extended period remain unaffected. Notify us of your clear decision by email to studies@easyelearning.academy or by post to EasyELEarning Academy GmbH, Saarburger Ring 10–12, 68229 Mannheim, Germany. Sending the notice before the deadline is sufficient.
Following a valid withdrawal, we refund payments received without undue delay and no later than 14 days after receiving your notice, normally using the original payment method without a refund fee. If you expressly requested services to begin during the withdrawal period, a proportionate amount for services already delivered may be payable where the statutory conditions are met. For paid services, the right expires early only upon full performance if, before performance begins, you expressly consented to performance starting before the withdrawal period ends and acknowledged that full performance results in loss of the right. Any additional statutory requirements remain unaffected. For paid digital content, early expiry requires, in particular, your separate express consent to early supply, acknowledgement of the resulting loss of the right, and the required contract confirmation. Agreement to these terms alone is insufficient.
You may also withdraw online using Withdraw from contract. Enter your name, information identifying the contract or part of it, and the email address for acknowledgment. Review your details and submit your declaration by selecting “Confirm withdrawal”. You will promptly receive an email acknowledgment containing your declaration and the date and time of receipt. Sending the declaration using the confirmation function before the withdrawal deadline is sufficient. Using this route is optional; the other withdrawal methods remain available.
